Welcome to Vidha Publication. These Terms and Conditions ("Terms") govern your use of our website, services, and any business relationship with Vidha Publication ("Company", "we", "us", or "our").

By accessing our website, submitting a manuscript, purchasing our services, or entering into any agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

These Terms are effective as of January 1, 2024, and supersede all previous versions. We reserve the right to update these Terms at any time, and will notify users of material changes via email or website notice.

If you do not agree with these Terms, please do not use our services or engage in business with us.

Vidha Publication provides comprehensive publishing services including but not limited to:

• Manuscript evaluation and editorial services

• Book design, typesetting, and cover creation

• ISBN assignment and copyright registration assistance

• Printing and production services

• Distribution through online and offline channels

• Marketing and promotional support

• E-book conversion and distribution

• Author website and platform development

The specific services included depend on the publishing package selected and the terms of your individual publishing agreement.

By submitting a manuscript to Vidha Publication, you represent and warrant that:

• You are the sole author and owner of the submitted work

• The work is original and does not infringe upon any copyright, trademark, or other intellectual property rights

• The work does not contain any libelous, unlawful, or objectionable material

• You have obtained all necessary permissions for any third-party content included

• The manuscript has not been previously published (unless disclosed)

We reserve the right to reject any manuscript that does not meet our quality standards, contains prohibited content, or is not suitable for our publishing program.

Submission of a manuscript does not guarantee publication. All submissions are subject to our editorial review process.

If your manuscript is accepted for publication, you will enter into a separate Publishing Agreement that details:

• Specific rights granted to Vidha Publication

• Royalty rates and payment terms

• Publication timeline and deliverables

• Marketing and distribution arrangements

• Territory and language rights

• Contract duration and termination clauses

The Publishing Agreement supersedes these general Terms for matters specifically addressed in that agreement.

Authors are encouraged to seek independent legal advice before signing any publishing agreement.

Unless otherwise specified in your Publishing Agreement:

• Authors retain copyright ownership of their work

• Vidha Publication receives limited publication rights as specified in the agreement

• Cover designs, interior layouts, and marketing materials created by us remain our property

• Authors grant us the right to use excerpts for promotional purposes

You agree to indemnify and hold Vidha Publication harmless from any claims arising from copyright infringement, plagiarism, or other intellectual property violations in your submitted work.

We respect intellectual property rights and will promptly address any valid copyright concerns brought to our attention.

Publishing Package Payments:

• All fees are quoted in Indian Rupees (₹) unless otherwise specified

• Payment schedules vary by package and are detailed in your agreement

• Accepted payment methods include bank transfer, credit/debit cards, UPI, and cheque

• GST (18%) and other applicable taxes will be added to all charges

• Payment plans and EMI options are available for packages above ₹50,000

Royalty Payments:

• Royalties are calculated quarterly based on net sales

• Minimum payout threshold is ₹1,000

• Payments are made within 30 days after quarter end

• Detailed royalty statements are provided with each payment

Refund Policy:

• Refunds are available within 7 days of payment if no work has commenced

• After work begins, refunds are prorated based on services completed

• No refunds are available after book production begins

As an author working with Vidha Publication, you agree to:

• Provide accurate and complete information in all communications

• Respond to editorial queries within reasonable timeframes

• Review and approve proofs within specified deadlines

• Cooperate with marketing and promotional activities

• Not engage in activities that could harm the reputation of your book or our company

• Maintain confidentiality of sensitive business information

• Comply with all applicable laws and regulations

Failure to meet these obligations may result in delays, additional costs, or termination of the agreement.

Distribution Channels:

• Books will be made available through our online store and selected partners

• Distribution channels vary by package and agreement terms

• We do not guarantee placement in physical bookstores

• International distribution is subject to additional terms and fees

Pricing:

• Retail prices are set in consultation with the author

• We reserve the right to offer promotional discounts and special offers

• Author copies are available at 40-50% discount from retail price

Returns and Damages:

• Industry-standard return policies apply to bookstore sales

• Damaged books will be replaced at no cost to customers

• Returns affect royalty calculations as per the Publishing Agreement

Either party may terminate the agreement under the following conditions:

• Mutual written consent

• Material breach not remedied within 30 days of written notice

• Bankruptcy or insolvency of either party

• Force majeure events preventing performance for over 90 days

Upon termination:

• All unpaid royalties will be settled within 60 days

• Unsold inventory may be purchased by the author at printing cost

• Rights revert to the author as specified in the Publishing Agreement

• Marketing materials and promotional content will be removed

• Confidentiality obligations survive termination

To the maximum extent permitted by law:

• Our total liability shall not exceed the amount paid by you for services

• We are not liable for indirect, incidental, or consequential damages

• We do not guarantee specific sales results or commercial success

• We are not responsible for third-party actions or services

You agree to indemnify Vidha Publication against:

• Claims arising from content in your work

• Breach of these Terms or your Publishing Agreement

• Violation of any laws or third-party rights

• Your negligent or intentional misconduct

We are committed to protecting your privacy and personal data:

• Personal information is collected and used as per our Privacy Policy

• We comply with applicable data protection laws

• Your data is secured using industry-standard measures

• We do not sell or rent personal information to third parties

• You have the right to access, correct, or delete your personal data

• Marketing communications are sent only with your consent

These Terms are governed by the laws of India.

Any disputes arising from these Terms or your relationship with Vidha Publication shall be resolved through:

1. Good faith negotiations between the parties

2. Mediation by a mutually agreed mediator

3. Arbitration under the Arbitration and Conciliation Act, 1996

4. The courts of Mumbai shall have exclusive jurisdiction
